Citizenship and Surrogacy

Australia has adopted the United Nations Convention on the Rights of the Child, the Hague Convention on Protection of Children and has extended cooperation in Intercountry Adoption apart from other international treaties. Protecting the fundamental rights of children is essential for the Australian government to prevent abduction or sale/trafficking of children.

Eligibility Requirements:

  • You need to keep yourself updated on the surrogacy and overseas laws in Australia.
  • Be aware of the laws on surrogacy arrangements in Australia in association with other countries
  • Take legal advice and help
  • Work out the arrangements of bringing the child to Australia and decide on the same

Incapable or Impaired

Australia confers Citizenship to persons who are incapable or impaired to undertake the usual citizenship process.

Eligibility Requirements:

  • You are 18 years and above
  • You have permanent or enduring physical or mental incapacity, or have a permanent loss or substantial impairment of hearing, speech or sight.
  • You are a permanent resident or have eligible New Zealand citizenship when you apply
  • You are in Australia when the decision of your application is being made
  • Intent to live in Australia or keep residency with Australia and overseas
